IR35 and The Employer's Annual Return
Now that the deadline to submit any outstanding personal Tax Returns to
the Inland Revenue has passed, contractors should expect to hear from
their accountants regarding the Employer's Annual Returns recently
issued by the Inland Revenue.
This year, the Annual Return contains two additional questions:
"Do the rules relating to payments for services provided through a
Service Company or partnership apply to any of your business income?"
"If yes, is PAYE and National Insurance on the deemed remuneration
included?"
In other words, are you caught by the IR35 and if so have you paid PAYE
and National Insurance in accordance with the rules?
This inclusion only strengthens our belief that the Inland Revenue
intends to enforce the IR35 legislation aggressively. Contractors
should be careful to ensure they answer these questions correctly and
if they are still unsure whether or not their contracts are "caught",
to seek urgent advice.
The Annual Return must be with the Inland Revenue by 19th May 2001 to
avoid the possibility of late filing penalties (payment must be made by
19th April 2001 to avoid interest). Additional penalties can also be
charged for making incorrect or false statements.

I am proud to announce that ATSCo is launching a new ATSCo-branded
distance-learning course for members and their employees.
The course, Ethical Practice in IT Recruitment, has been developed by
one of our [affiliate] members, The Curve, and is being led by a
leading employment law specialist. It will cover all aspects of our
Code of Practice and will explore new legislation and issues such as
IR35.
It is good to see that client companies are recognising the ATSCo logo
as a guarantee of quality and I am sure they will see a further
enhancement in the level of service once their employees begin studying
for the programme.
It's very important to ensure that staff at the coal face understand
and work to the highest ethical standards. This course will ensure they
are up to date with all legislation and topics affecting the IT
