Indeed, this is a major problem and one that started me thinking
about "what is spam?"
I have been told by ISPs and hosting companies that they would -- and
even SEEN hosting companies -- shut down people's accounts if they
got reports of spam. No chance for explanation, no questions asked,
just boom, you're cut off.
In one case, I know for a fact that the person didn't send out spam.
What happened was site XYZ hired a 3rd party (SpamCo Software) to
work on his site. SpamCo later sent out commercial solicitations and
listed site XYZ as a site they had worked on. Someone complained to
XYZ's hosting company and the morons shut down his site -- without
contacting him -- as if he had done something wrong. Shrug.
Then it hit me: we have some trigger happy lynch mobs out there (and
some more reasonable people too).
